    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165 si 167 din Legea nr. 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintelor: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completare DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1.Persoane cu functie de decizie din cadrul autoritatii contractante: S.L.Dr.Sorin Barac, Dr.Horia Haragus, Ing. Petre Ion, Badea Cristina, Fota Andreea, Alina Suciu, Tatiana Sinoi, Alina Ciobanu, Claudia Murgu. Se solicita declaratie privind neincadrarea in prevederile art. 60 din Legea nr. 98/2016 pentru ofertant, asociat, subcontractant si tertul sustinator. Certificatele fiscale pentru operatorii romani: certificate constatatoare privind lipsa la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc) la momentul prezentarii. Certificatele fiscale - persoane juridice straine - ofertantii straini vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca indeplinirea obligatiilor restante de plata a impozitelor catre bugetul de stat in conformitate cu legislatia din tara de rezidenta. Operatorul economic (lider, asociat, tert sustinator si subcontractant) va completa cerinta corespunzatoare in formularul DUAE din documentatia de atribuire. Acest certificat de atestare trebuie prezentat, la solicitarea autoritatii contractante, numai de ofertantul clasat pe primul loc, dupa aplicarea criteriului de atribuire (inclusiv de ofertantul asociat sau tertul sustinator dupa caz sau subcontractant), pana la data incheierii raportului procedurii, conform art. 196 alin. 2 din legea nr. 98/2016 privind achizitiile publice. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea de indeplinire: completare DUAE in conformitate cu Notificarea nr. 240/2016 urmand ca documentul justificativ, respectiv certificat ONRC sau pentru ofertantii straini, document echivalent emis in tara de rezidenta, sa fie prezentat la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Informatiile cuprinse in certificatul constatator sa fie actualizate la momentul prezentarii documentului (art. 196, alin. 2 din Legea nr.98/2016).

      Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.

      Interactiunea cu ofertantii, respectiv procesul de evaluare a ofertelor se va desfasura dupa urmatoarele reguli: Pentru vizualizarea documentatiei de atribuire incarcate in SICAP, operatorii economici trebuie sa aiba un program necesar vizualizarii fisierelor semnate elecronic (site-urile furnizorilor de semnatura electronica). Reguli de comunicare si transmitere a datelor: solicitarile de clarificari referitoare la prezenta documentatie de atribuire se vor adresa in mod exclusiv, in SICAP, la sectiunea „Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice, iar raspunsurile la acestea vor fi publicate in SICAP, la sectiunea „Documetatie, clarificari si decizii” din cadrul Anuntului de participare simplificat. Pentru comunicarile ulterioare depunerii ofertelor, comisia de evaluare va transmite solicitarile de clarificari in legatura cu oferta prin utilizarea facilitatilor tehnice disponibile in SICAP (sectiunea „Intrebari”) Comisia de evaluare va analiza DUAE in corelatie cu cerintele stabilite prin fisa de date a achizitiei. Comisia de evaluare va analiza si verifica fiecare oferta din punct de vedere al elementelor tehnice propuse, iar ulterior din punct de vedere al aspectelor financiare pe care le implica. Operatorii vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SICAP (sectiunea „Intrebari”), in format electronic semnate cu semnatura electronica. Modalitatea de departajare a ofertelor clasate pe primul loc, cu preturi egale. Departajarea se va face exclusiv in functie de pret si nu prin cuantificarea altor elemente de natura tehnica sau alte avantaje care rezulta din modul de indeplinire a contractului de catre operatorii economici. In vederea departajarii ofertelor, autoritatea contractanta va solicita depunerea in SICAP a unor noi oferte financiare (procedura fiind desfasurata integral prin mijloace electronice).Preturile noi ofertante nu pot depasi valoarea ofertata anterior.Pentru ofertantii care nu vor prezenta o noua oferta de pret pana la data stabilita de care comisia de evaluare se va lua in considerare valoarea din oferta anterioara. Procesul de reofertare se va repeta o singura data.
