        Ofertantul va face dovada ca nu se incadreaza la situatiile prevazute de art 60, 164, art 165, art.167 din Legea 98/2016. Declaratia privind neincadrarea in prev. art. 60 se va prezenta odata cu DUAE. Modalitatea prin care poate fi demonstrata indeplinirea cerintelor: Se va prezenta DUAE in conformitate cu prevederile art. 193 alin 1 din Legea 98/2016 iar documentele justificative care probeaza indeplinirea celor asumate in DUAE urmeaza a fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Cerintele privind neincadrarea in situatiile prevazute la art.60, art.164, art 165, art.167 se adreseaza si subcontractantilor si tertilor conform art. 170/1 si 183/1 din Legea 98/2016. Documentele justificative vor putea fi, in masura in care furnizeaza toate informatiile solicitate in DUAE, urmatoarele:

        1. Certificate constatatoare privind plata obligatiilor la bugetul general consolidat (bugetul local si bugetul de stat) care sa confirme faptul ca ofertantul si-a indeplinit obligatiile RESTANTE de plata a impozitelor, taxelor si contributiilor de asigurari sociale la sediul principal, valabil la momentul prezentarii. Declarație pe proprie răspundere privind îndeplinirea obligațiilor de plată a impozitelor, taxelor sau contribuțiilor la bugetul general consolidat datorate – pentru sediile secundare/punctele de lucru;

        2. Cazier judiciar pentru operatorul economic;

        3. Cazier judiciar al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;

        4. Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

        5. Orice documente echivalente emise de autoritati din tara in care ofertantul este rezident;

        7. Orice alte documente edificatoare.

        IN CAZUL OFERTANTILOR STRAINI: Autoritatea contractanta va respecta prev. art 183, alin. (1) si (3) din Legea nr 98/2016 in ceea ce priveste ofertantii straini, respectiv autoritatea contractanta are obligatia de a accepta ca fiind suficient si relevant pentru demonstrarea faptului ca ofertantul/candidatul nu se incadreaza in prev. art. 164, 165 si 167, orice document considerat edificator, din acest punct de vedere , in tara de origine sau in tara in care ofertantul/ candidatul este stabilit, cum ar fi certificate, caziere judiciare sau alte documente echivalente emise de autoritati competente din tara respectiva. DUAE va fi completat în SEAP în mod direct, după autentificare, de către fiecare operator economic din grupul participant la procedură (ofertant, ofertant asociat, subcontractant, terț susținător). Detalii cu privire la întocmirea DUAE se regăsesc, după autentificarea în sistem, în secțiunea „Informații DUAE” – Ghid de completare DUAE’’.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna din situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

        Modalitate de indeplinire: completare DUAE in conformitate cu prev. art. 193 alin. 1 din Legea 98.2016.         Completare DUAE conform art. 193 din Legea 98/2016. Se va completa DUAE de către operatorii economici participanţi la procedura de atribuire cu informaţiile ce descriu nivelul lor de experienţă, prin raportare la contractele executate în trecut, corespunzător cerinţelor autorităţii contractante. La nivelul DUAE trebuie precizate informaţii cum ar fi: numărul şi data contractului invocat drept experienţă similară, tipul/categoriile de produse furnizate, valoarea in lei fara TVA, numărul si data documentului de recepţie. Livrarile de produse se confirma prin prezentarea de: procese verbale de receptie/ procese verbale de predare-primire, documente constatatoare/ recomandari emise sau contrasemnate de o autoritate contractanta/ beneficiar final din care sa reiasa denumirea/ numarul contractului, obiectul contractului, tipul produselor furnizate, beneficiarul, valoarea contractului exprimata in LEI fara TVA, perioada si locul furnizarii produselor, ponderea procentuala realizata de catre operatorul economic, din valoarea totala a contractului. Asociatul/asociatii nominalizati va/vor prezenta DUAE distinct in care se vor cuprinde informatiile solicitate Pentru confirmarea informatiilor declarate de catre ofertant, autoritatea contractanta are dreptul de a se adresa, daca este cazul, direct beneficiarului final al lucrarilor care fac obiectul contractelor prezentate drept experienta similara.

        In DUAE completat de ofertant se vor include şi informaţiile solicitate cu privire la subcontractanţi. Dacă prin subcontractare nu se îndeplinește o cerință de calificare, atunci acesta va prezenta DUAE doar în scopul demonstrării neîncadrării în motivele de excludere. Subcontractanții precizează în DUAE informațiile aferente criteriilor de calificare pe care le îndeplinesc menţionând numărul şi data contractului / acordului de subcontractare pentru partea propusă pentru subcontractare.
