        1. Declaratia va consta in completarea si depunerea formularului DUAE;

        Declaratie pe propria raspundere privind neincadrarea in situatiile prevazute la art. 60 din Legea 98/2016: Ofertantul va completa Formularul 2. Persoanele ce detin functii de decizie in cadrul autorității contractante sunt: Director General – MĂRĂCINEANU Gelu Agafiel, Director General Adjunct – COMIATI Marian, Contabil Șef – MANEA Adrian, Șef Serviciu Achiziții publice – CIUPAG Andra Nicoleta, responsabil cu execuția contractului, Manager energetic – GRIGORIU Eugen, Expert Achiziții publice – IORDACHE Ioana, Responsabil cu atribuții CFP – GABOR Elena Angela, Inginer – VESA Sorin Florian, consilier juridic – EFTIN Emilia Adina.

        2. Documente justificative care probeaza indeplinirea celor asumate prin completarea DUAE si care urmeaza a fi prezentate, la solicitarea entitatii contractante, de catre ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, respectiv:

        2.1. Certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc) la momentul prezentarii;

        2.2. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;

        2.3. Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin.(2), art. 171 din Legea 98/2016 privind achizitiile publice;

        2.4. Alte documente edificatoare, dupa caz.

        Entitatea contractanta exclude operatorii economici, subcontractantii propusi (daca este cazul) aflati in situatiile prevazute la art. 164, 165 și 167 din Legea 98/2016. In cazul in care este identificata o situatie de excludere, cu aplicarea in mod corespunzator a dispozitiilor art. 171 din Legea 98/2016 devin aplicabile prevederile art. 170 alin 2 din Legea 98/2016. In cazul tertului sustinator/ subcontractantului/ asociatului (daca este cazul) se va completa declaratia pe proprie raspundere conform prevederilor art. 193, precizand ca nu se afla in niciuna din situatiile ce atrag excluderea din procedura de atribuire.

        Formularele se vor completa daca este cazul si de asociat/ tert sustinator/ subcontractant.

        Nota: 1. În cazul in care exista incertitudini in ceea ce priveste situatia personala a respectivilor candidati/ofertanti, autoritatea contractanta are dreptul de a solicita in mod direct informatii de la autoritatile competente sau de la entitatile care emit documente de natura celor prevazute de legislatie/ solicitate.

        2. Pentru persoanele straine devin aplicabile prevederile art. 170 din legea nr. 98/2016.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC sau, in cazul ofertantilor straini, documente echivalente emise de tara de rezidenta, urmeaza sa fie prezentate, la solicitarea entitatii contractante, doar de catre ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
