         1) zdolności do występowania w obrocie gospodarczym - Zamawiający wymaga aby Wykonawca był wpisany do rejestru handlowego prowadzonego w kraju, w którym ma siedzibę lub miejsce zamieszkania,

         2) uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów – Zamawiający wymaga, aby Wykonawca posiadał koncesję na prowadzenie hurtowni farmaceutycznej lub posiadał pozwolenie na wytwarzanie produktu leczniczego.

         3) zezwolenie na obrót hurtowy środkami odurzającymi lub substancjami psychotropowymi - Zamawiający wymaga, aby Wykonawca posiadał pozwolenie na obrót narkotykami i substancjami psychotropowymi dla części, gdzie takie leki są wymienione.
