  Zamawiający wskazuje, iż w myśl art. 138 ust. 2 pkt 2) ustawy wyznaczył termin składania ofert krótszy niż termin określony w art. 138 ust. 1 ustawy Pzp z uwagi na to, iż zachodzi pilna potrzeba udzielenia zamówienia i skrócenie terminu składania ofert jest uzasadnione z uwagi na konieczność dostawy do dnia 15.12.2023 r., ze względu na konieczność rozliczenia środków, które są finansowane z projektu wskazanego w paragrafie 3 SWZ.         Środki ochrony prawnej przysługują Wykonawcy, a także innemu podmiotowi, jeżeli ma lub miał interes w uzyskaniu zamówienia oraz poniósł lub może ponieść szkodę w wyniku naruszenia przez Zamawiającego przepisów ustawy. Środki ochrony prawnej wobec ogłoszenia wszczynającego postępowanie o udzielenie zamówienia oraz dokumentów zamówienia przysługują również organizacjom wpisanym na listę, o której mowa w art. 469 pkt 15 Ustawy oraz Rzecznikowi Małych i Średnich Przedsiębiorców.
        
        Odwołanie wnosi się do Prezesa Krajowej Izby Odwoławczej w formie pisemnej lub w postaci elektronicznej, podpisane bezpiecznym podpisem elektronicznym weryfikowanym przy pomocy ważnego kwalifikowanego certyfikatu lub opatrzone podpisem zaufanym. Odwołanie wnosi się w terminie określonym w artykule 515 PZP.
        
        Odwołujący przekazuje kopię odwołania Zamawiającemu przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.
        
        Odwołanie wnosi się w terminach określonych w art. 515 Ustawy.
        
        Zasady i tryb postępowania w zakresie korzystania ze środków ochrony prawnej określone zostały w Dziale IX Ustawy.
