Odwołanie wnosi się do Prezesa Izby w formie pisemnej lub w postaci elektronicznej, podpisane bezpiecznym podpisem elektronicznym weryfikowanym przy pomocy ważnego kwalifikowanego certyfikatu lub równoważnego środka, spełniającego wymagania dla tego rodzaju podpisu. 5.Odwołujący przesyła kopię odwołania Zamawiającemu przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu. Domniemywa się,iż zamawiający mógł zapoznać się z treścią odwołania przed upływem terminu do jego wniesienia, jeżeli przesłanie jego kopii nastąpiło przed upływem terminu do jego wniesienia przy użyciu środków komunikacji elektronicznej. 6. Odwołanie wnosi się w terminie 10 dni od dnia przesłania informacji o czynności zamawiającego stanowiącej podstawę jego wniesienia – jeżeli zostały przesłane w sposób określony w pkt 5 albo w terminie15 dni jeżeli zostały przesłane w inny sposób. 7. Odwołanie wobec treści ogłoszenia o zamówieniu oraz wobec postanowień specyfikacji istotnych warunków zamówienia wnosi się w terminie 10 dni od dnia zamieszczenia ogłoszenia w Dzienniku Urzędowym Unii Europejskiej lub zamieszczenia specyfikacji istotnych warunków zamówienia na stronie internetowej. 8.Odwołanie wobec czynności innych niż w pkt. 6 7 nosi się w terminie 10dni od dnia, w którym powzięto,lub przy zachowaniu należytej staranności można było powziąć wiadomość o okolicznościach stanowiących podstawę jego wniesienia. 9. Jeżeli Zamawiający nie opublikował ogłoszenia o zamiarze zawarcia umowy lub mimo takiego obowiązku nie przesłał Wykonawcy zawiadomienia o wyborze oferty najkorzystniejszej, odwołanie wnosi się nie później niż w terminie: 9.1.30 dni od dnia publikacji w Dzienniku Urzędowym Unii Europejskiej. 9.2. 6 miesięcy od dnia zawarcia umowy, jeżeli Zamawiający nie opublikował w Dzienniku Urzędowym Unii Europejskiej ogłoszenia o udzieleniu zamówienia 10. Środki ochrony prawnej wobec ogłoszenia o zamówieniu oraz specyfikacji istotnych warunków zamówieniaprzysługują również organizacjom wpisanym na listę prowadzoną przez prezesa Urzędu Zamówień Publicznychi ogłaszaną na stronie internetowej Urzędu. Szczegółowe informacje dotyczące środków ochrony prawnej określa Dział VI ustawy Prawo zamówień publicznych. Zgodnie z art.13ust.1 i 2 rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27.4.2016r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o danych) (Dz. U. UE L119 z dnia 4 maja 2016 r., str. 1; zwanym dalej "RODO") informujemy, że:
