        Additional information
        
        1. W postępowaniu mogą wziąć udział wyłącznie wykonawcy, którzy nie podlegają wykluczeniu z postępowania na podstawie:
        
        1) art. 108 ust. 1 i ust. 2 ustawy z dnia 11 września 2019 r. Prawo zamówień publicznych (Dz. U. z 2022 r., poz. 1710 z późn. zm.);
        
        2) art. 5k ust. 1 rozporządzenia (UE) nr 833/2014 z dnia 31 lipca 2014 r. dotyczącego środków ograniczających w związku z działaniami Rosji destabilizującymi sytuację na Ukrainie (Dz. Urz. UE nr L 229 z 31.7.2014, str. 1 z późn. zm.);
        
        3) art. 7 ust. 1 pkt 1-3 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (Dz. U. z 2023 r., poz. 129 z późn. zm.), tj.:
        
        a) wymienionych w wykazach określonych w rozporządzeniu Rady (WE) nr 765/2006 z dnia 18 maja 2006 r. i rozporządzeniu Rady (UE) nr 269/2014 z dnia 17 marca 2014 r. albo wpisanych na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, o którym mowa w art. 1 pkt 3 tej ustawy;
        
        b) których beneficjentem rzeczywistym w rozumieniu ustawy z dnia 1 marca 2018 r. o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu (Dz.U.z 2022 r. poz. 593 i 655) jest osoba wymieniona w wykazach określonych w rozporządzeniu Rady (WE) nr 765/2006 z dnia 18 maja 2006 r. i rozporządzeniu Rady (UE) nr 269/2014 z dnia 17 marca 2014 r. albo wpisana na listę lub będąca takim beneficjentem rzeczywistym od dnia 24 lutego 2022 r., o ile została wpisana na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, o którym mowa w art. 1 pkt 3 tej ustawy;
        
        c) których jednostką dominującą w rozumieniu art. 3 ust. 1 pkt 37 ustawy z dnia 29 września 1994 r. o rachunkowości (Dz.U. z 2023 r. poz. 120 z późn. zm.) jest podmiot wymieniony w wykazach określonych w rozporządzeniu Rady (WE) nr 765/2006 z dnia 18 maja 2006 r. i rozporządzeniu Rady (UE) nr 269/2014 z dnia 17 marca 2014 r. albo wpisany na listę lub będący taką jednostką dominującą od dnia 24 lutego 2022 r., o ile został wpisany na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, o którym mowa w art. 1 pkt 3 tej ustawy.
        
        2. Żaden z wykonawców występujących wspólnie nie może podlegać z osobna wykluczeniu z postępowania na podstawie okoliczności wymienionych w ust. 1.
        
        3. Wykaz oświadczeń i dokumentów potwierdzających brak podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu określa dokumentacja zamówienia.
        
        4. Instytucja zamawiająca nie żąda wniesienia wadium.

        Odwołanie wnosi się do Prezesa Krajowej Izby Odwoławczej w terminach określonych odpowiednio w art. 515 ustawy z dnia 11 września 2019 r. Prawo zamówień publicznych (Dz. U. z 2022 r., poz. 1710 z późn. zm.).
        
        Odwołujący przekazuje zamawiającemu odwołanie wniesione w formie elektronicznej albo postaci elektronicznej albo kopię tego odwołania, jeżeli zostało ono wniesione w formie pisemnej, przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.
