         Warunek udziału w postępowaniu w zakresie uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów zostanie uznany za spełniony, jeżeli Wykonawca wykaże, że posiada:

         a) aktualną koncesję na prowadzenie działalności gospodarczej w zakresie obrotu energią elektryczną, wydaną przez Prezesa Urzędu Regulacji Energetyki, zgodnie z art. 32 ustawy z dnia z dnia 10 kwietnia 1997 r. – Prawo Energetyczne (Dz.U. z 2022 poz. 1385 z późn. zm.);

         b) aktualną koncesję na prowadzenie działalności gospodarczej w zakresie dystrybucji energii elektrycznej wydaną przez Prezesa Urzędu Regulacji Energetyki zgodnie z przepisami ustawy z dnia 10 kwietnia 1997 r. Prawo Energetyczne (Dz. U. z 2022 r. poz. 1385 z późn. zm.) lub Wykonawca przedstawi oświadczenie o posiadaniu podpisanej umowy z Operatorem Systemu Dystrybucyjnego „OSD” na zapewnienie świadczenia usług dystrybucji energii elektrycznej przez OSD zgodnie z Załącznikiem nr 7 do SWZ.
