         1. O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy:

         1) nie podlegają wykluczeniu z Postępowania na podstawie art. 108 ust. 1 pkt 1 – 6 ustawy Pzp oraz art. 109 ust. 1 pkt 4 i 6 ustawy Pzp, z zastrzeżeniem art. 110 ust. 2 ustawy Pzp, w tym

         2) spełniają warunki udziału w Postępowaniu określone w ust. 2.

         3) nie podlegają wykluczeniu na podstawie:

         a) art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. ustawy o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (Dz.U. z 2022 r. poz. 835),

         b) art. 5k rozporządzenia Rady (UE) nr 833/2014 z dnia 31 lipca 2014 r. (Dz. Urz. UE nr L 229 z 31.7.2014, str. 1).

         2. Wykonawca biorący udział w postępowaniu musi:

         1) wykazać, że w okresie ostatnich trzech lat przed upływem terminu składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, należycie wykonał lub wykonuje (w przypadku świadczeń okresowych lub ciągłych) umowy na dostawę części do silników spalinowych do taboru kolejowego, o łącznej wartości nie mniejszej niż:

         a) dla Zadania 1 – 20 000,00 zł (dwadzieścia tysięcy złotych)

         b) dla Zadania 2 – 150 000,00 zł (sto pięćdziesiąt tysięcy złotych)

         c) dla Zadania 3 – 100 000,00 zł (sto tysięcy złotych)

         d) dla Zadania 4 – 25 000,00 zł (dwadzieścia pięć tysięcy złotych)

         e) dla Zadania 5 – 15 000,00 zł (piętnaście tysięcy złotych)

         f) dla Zadania 6 – 10 000,00 zł (dziesięć tysięcy złotych)

         W przypadku umów niezakończonych, Zamawiający weźmie pod uwagę wyłącznie wartość danej umowy w części faktycznie zrealizowanej, która będzie odpowiadać minimalnej wymaganej wartości brutto.

         c) dla Zadania 3 – 2 400,00 zł (dwa tysiące czterysta złotych 00/100)

         d) dla Zadania 4 – 500,00 zł (pięćset złotych 00/100)

         e) dla Zadania 5 – 300,00 zł (trzysta złotych 00/100)

         f) dla Zadania 6 – 200,00 zł (dwieście złotych 00/100)

         W przypadku gdy Wykonawca składa ofertę na więcej niż jedno Zadanie, odpowiednio sumuje powyższe wartości.
