        1. Przedmiotem zamówienia jest dostawa obłożeń operacyjnych dla potrzeb Międzyleskiego Szpitala Specjalistycznego w Warszawie.

        2. Przedmiot zamówienia został podzielony na 22 grupy zadaniowe, w ilościach i asortymencie wykazanych w Formularzach Cenowych stanowiących integralne części niniejszej SWZ.

        3. Zamawiający zastrzega sobie prawo, a Wykonawca wyraża zgodę na składanie zamówień bez ograniczeń, w ramach niniejszej umowy, a także prawo do korekty zamówionych ilości w dół lub w górę w przypadku zaistnienia okoliczności, których Zamawiający nie mógł przewidzieć z zastrzeżeniem, że minimalna wartość całego zamówienia wyniesie nie mniej niż 30%.

        4. Oferta może dotyczyć wszystkich lub wybranych Zadań. Nie dopuszcza się składania ofert częściowych w obrębie poszczególnych Zadań.

        5. Zamawiający nie dopuszcza składania ofert wariantowych. .

        6. Realizacja zamówienia następować będzie przez okres 12 miesięcy od dnia zawarcia ważnej umowy z Wykonawcą.

                                              1. Odwołanie przysługuje na:

                                              1.1. niezgodną z przepisami ustawy czynność zamawiającego, podjętą w postępowaniu o udzielenie zamówienia, o zawarcie umowy ramowej, dynamicznym systemie zakupów, systemie kwalifikowania wykonawców lub konkursie, w tym na projektowane postanowienie umowy;

                                              1.2. zaniechanie czynności w postępowaniu o udzielenie zamówienia, o zawarcie umowy ramowej, dynamicznym systemie zakupów, systemie kwalifikowania wykonawców lub konkursie, do której zamawiający był obowiązany na podstawie ustawy;

                                              1.3. zaniechanie przeprowadzenia postępowania o udzielenie zamówienia lub zorganizowania konkursu na podstawie ustawy, mimo że zamawiający był do tego obowiązany.

                                              2. Odwołanie wnosi się 10 dni od dnia przekazania informacji o czynności zamawiającego stanowiącej podstawę jego wniesienia, jeżeli informacja została przekazana przy użyciu środków komunikacji elektronicznej.

                                              3. Odwołanie wnosi się do Prezesa Izby.

                                              4. Odwołanie Odwołujący przekazuje Zamawiającemu odwołanie wniesione w formie elektronicznej albo postaci elektronicznej albo kopię tego odwołania, jeżeli zostało ono wniesione w formie pisemnej, przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.

                                              5. Domniemywa się, że zamawiający mógł zapoznać się z treścią odwołania przed upływem terminu do jego wniesienia, jeżeli przekazanie odpowiednio odwołania albo jego kopii nastąpiło przed upływem terminu do jego wniesienia przy użyciu środków komunikacji elektronicznej.

                                              6. Szczegółowe zasady dotyczące stosowania odwołań określa dział IX ustawy z dnia 11 września 2019 r. Prawo zamówień publicznych (tekst jednolity: Dz. U. z 2022 r., poz. 1710 z póź. zm.).
