         1) koncesję na sprzedaż energii elektrycznej, o której mowa w przepisach ustawy Prawo energetyczne

         2) podpisane umowy o świadczenie usług dystrybucyjnych z operatorami systemu dystrybucyjnego: Energa-Operator SA, Enea -Operator Sp. z o.o., PGE Dystrybucja SA, PKP Energetyka SA

Wykonawca ubiegający się o udzielenie zamówienia musi spełniać warunek dotyczący wiedzy i doświadczenia w zakresie należytego wykonania co najmniej 2 zadań w okresie ostatnich 3 lat przed upływem terminu składania ofert polegające na dostawie energii elektrycznej w ilości rocznej co najmniej:

         - dla Elementu I, III i V - 9000 MWh każda

         - dla Elementu II - 10.000 MWh każda

         - dla Elementu IV - 12.000 MWh każda
