         Zamawiający uzna warunek za spełniony, jeżeli Wykonawca wykaże, że posiada:

         - zezwolenie uprawniające do obrotu produktami leczniczymi wydane przez Głównego Inspektora Farmaceutycznego, zgodnie z ustawą Prawo Farmaceutyczne z dnia 6 września 2001 r. W przypadku hurtowni spoza RP nieposiadających zezwolenia uprawniającego do obrotu produktami leczniczymi wydanego przez Głównego Inspektora Farmaceutycznego wymagane jest zaświadczenie wydane przez Głównego Inspektora Farmaceutycznego o możliwości zaopatrywania Aptek Szpitalnych podmiotów leczniczych w produkty lecznicze lub zezwolenie uprawniające do obrotu produktami leczniczymi wydane przez odpowiedni organ państwa członkowskiego UE/EFTA.

         Warunki realizacji przedmiotu zamówienia zawarte zostały w projektowanych postanowieniach umowy w sprawie zamówienia publicznego, które zostaną wprowadzone do treści tej umowy, stanowiących Załącznik nr 4 do SWZ.

      Zastosowano art. 138 ust. 2 pkt 2 ze względu na wprowadzenie nowych leków stosowanych i rozliczanych od 01.09.2023, w ramach programu B.37, B.95, B.96 dla których Zamawiający nie mógł przewidzieć zapotrzebowania. Istnieje pilna potrzeba udzielenia zamówienia a tym samym skrócenia terminu składania ofert do 15 dni ze względu na konieczność pilnej realizacji umów nowo zawartych przez UCKWUM z NFZ na realizację programów lekowych. Brak przedmiotowych produktów leczniczych w UCK WUM CSK, SKDJ i DSK uniemożliwia realizację zawartych zobowiązań. Istnieje pilna potrzeba zastosowania i wykorzystywania przedmiotowych leków przez Oddziały CSK, DSK, SKDJ. Ze względu na charakter przedmiotu zamówienia oraz obecność produktów leczniczych na listach refundacyjnych MZ przygotowanie przez wykonawców ofert nie będzie czasochłonne wobec czego skrócenie terminu na składanie ofert nie powinno w żaden sposób wpłynąć na konkurencyjność postępowania.
