        1. Warunkiem przysługiwania środków ochrony prawnej jest istnienie interesu w uzyskaniu zamówienia oraz poniesienie lub możliwość poniesienia szkody w wyniku naruszenia przez ZAMAWIAJĄCEGO przepisów ustawy Prawo zamówień publicznych. 2. Odwołanie powinno wskazywać czynność lub zaniechanie czynności ZAMAWIAJĄCEGO, której zarzuca się niezgodność z przepisami ustawy, zawierać zwięzłe przytoczenie zarzutów, wskazywać żądanie oraz okoliczności faktyczne i prawne uzasadniające wniesienie odwołania. 3. Odwołanie wnosi się do Prezesa Izby w formie pisemnej w terminie 10 dni od dnia przesłania informacji o czynności ZAMAWIAJĄCEGO stanowiącej podstawę jego wniesienia - jeżeli zostały przesłane przy użyciu środkami komunikacji elektronicznej albo w terminie 15 dni - jeżeli zostały przesłane w inny sposób. Odwołanie wobec treści ogłoszenia o zamówieni i wobec treści specyfikacji wnosi się w terminie 10 dni od dnia zamieszczenia ogłoszenia w Dzienniku Urzędowym Unii Europejskiej lub specyfikacji istotnych warunków zamówienia na stronie internetowej. 4. Kopię odwołania należy przesłać ZAMAWIAJĄCEMU przed upływem terminu do wniesienia odwołania, aby mógł on zapoznać się z jego treścią. 5. ZAMAWIAJĄCY nie później niż 2 dni od otrzymania kopii odwołania, przekazuje ją innym WYKONAWCOM uczestniczącym w postępowaniu, a jeżeli odwołanie dotyczy treści ogłoszenia lub postanowień specyfikacji, zamieszcza ją również na stronie internetowej, wzywając WYKONAWCÓW do wzięcia udziału w postępowaniu odwoławczym. 6. WYKONAWCA może zgłosić przystąpienie do postępowania odwoławczego w terminie 3 dni od dnia otrzymania kopii odwołania, wskazując stronę, do której przystępuje i interes w uzyskaniu rozstrzygnięcia na korzyść tej strony. Zgłoszenie przystąpienia doręcza się Prezesowi Izby, przekazując jego kopię ZAMAWIAJĄCEMU oraz WYKONAWCY wnoszącemu odwołanie. 7. Na wyrok oraz postanowienia Krajowej Izby Odwoławczej kończące postępowanie odwoławcze przysługuje skarga do Sądu Okręgowego w Szczecinie, którą wnosi się za pośrednictwem Prezesa Urzędu w terminie 7 dni od dnia doręczenia orzeczenia Izby.
