         Warunek ten zostanie spełniony, jeżeli Wykonawca przedłoży zezwolenie na prowadzenie działalności objętej przedmiotem zamówienia – tj. zezwolenie na prowadzenie hurtowni farmaceutycznej albo zezwolenie na wytwarzanie, jeżeli wykonawca jest wytwórcą lub odpowiednio w przypadku wykonawcy prowadzącego skład konsygnacyjny – zezwolenie na prowadzenie składu zawierające uprawnienia w zakresie obrotu produktami leczniczymi.

         Warunek zostanie wstępnie zweryfikowany na podstawie wypełnionej Części IV: Kryteria kwalifikacji poprzez złożenie ogólnego oświadczenia dotyczącego wszystkich kryteriów kwalifikacji w pkt. α (alfa) w JEDZ.

      Skrócenie terminu składania ofert zostało zastosowane w związku z powtórzeniem postępowania przetargowego na asortyment, który w poprzednim postępowaniu został unieważniony lub wprowadzeniem nowych leków do istniejących programów lekowych lub w związku z wydaniem zgody przez Ministra Zdrowia na ratunkowy dostęp do technologii lekowej (RDTL). W związku z powyższym aby zapewnić dostęp do przedmiotowego asortymenty oraz zachować ciągłość pracy Zamawiający skorzystał z dyspozycji art. 138 ust 2 pkt 2 ustawy PZP.
