   1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
         List and brief description of conditions:

         1. Zamawiający na podstawie art. 112 ustawy PZP określa warunki udziału w postępowaniu, które dotyczą:

         1) Zdolności do występowania w obrocie gospodarczym Zamawiający nie stawia w tym zakresie szczegółowych warunków, które spełni Wykonawca.

         2) Uprawnień do wykonywania określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów.

         a) Zamawiający uzna warunek za spełniony, jeżeli Wykonawca przedstawi że posiada ważne, aktualne uprawnienia do obrotu produktami farmaceutycznymi (w przypadku Wykonawcy mającego siedzibę lub miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej – dokument równoważny), zgodnie z ustawą z dnia 6 września 2001 r. Prawo farmaceutyczne (tekst jednolity Dz.U. 2020 poz. 944 ze zm.), tj. np.: zezwolenie Głównego Inspektora Farmaceutycznego lub koncesję na podjęcie działalności gospodarczej w zakresie wytwarzania produktów leczniczych lub prowadzenia hurtowni farmaceutycznej lub składu konsygnacyjnego produktów leczniczych, lub inny dokument równoważny umożliwiający obrót przedmiotem zamówienia – dotyczy wyłącznie oferowanych produktów farmaceutycznych,

         b) w przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia warunki, o których mowa w ust. 1 pkt 1.2. zostaną spełnione jeżeli przynajmniej jeden z Wykonawców wspólnie ubiegających się o udzielenie zamówienia będzie posiadał ww. uprawnienia. Wykonawca który w ramach wspólnego ubiegania się o udzielenie zamówienia wykaże posiadanie stosownych uprawnień musi realizować, tą części zamówienia, z którą wiąże się obowiązek posiadania wymaganych uprawnień.

         3) Sytuacji ekonomicznej lub finansowej Zamawiający nie stawia w tym zakresie szczegółowych warunków, które spełni Wykonawca.

         4) Zdolności technicznej lub zawodowej Zamawiający nie stawia w tym zakresie szczegółowych warunków, które spełni Wykonawca.
