Additional information

1. O udzielenie zamówienia mogą ubiegać się wykonawcy, którzy:

1) nie podlegają wykluczeniu na podstawie art. 108 ustawy Pzp, z zastrzeżeniem art. 110 ust. 2 Pzp;

2) nie podlegają wykluczeniu na podstawie art. 7 ust. 1 pkt 1-3 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (tekst jedn. Dz. U. z 2023 poz. 1497);

3) nie podlegają wykluczeniu na podstawie art. 5k Rozporządzenia 833/2014 (...).

Wykonawcy mogą wspólnie ubiegać się o udzielenie zamówienia i w takim przypadku ustanawiają pełnomocnika do reprezentowania ich w postępowaniu albo do reprezentowania w postępowaniu i zawarcia umowy w sprawie zamówienia publicznego.

Przepisy dotyczące wykonawcy stosuje się odpowiednio do wykonawców wspólnie ubiegających się o udzielenie zamówienia.

2. Wykonawca składając ofertę składa:

2.1. Oświadczenie, o którym mowa w art. 125 ust. 1 ustawy Pzp – wg zał. nr 4 do SWZ. Zamawiający przygotował formularz JEDZ w formacie .xml.

a) W przypadku wspólnego ubiegania się o zamówienie przez Wykonawców oświadczenie składa każdy z Wykonawców wspólnie ubiegających się o zamówienie. Oświadczenia te potwierdzają brak podstaw wykluczenia oraz spełnianie warunków udziału w postępowaniu w zakresie, w jakim każdy z wykonawców wykazuje spełnianie warunków udziału w postępowaniu.

b) Oświadczenia JEDZ podmiotów składających ofertę wspólnie, muszą mieć postać elektroniczną, podpisaną kwalifikowanym podpisem elektronicznym przez każdy z tych podmiotów w zakresie w jakim potwierdzają okoliczności, o których mowa w treści art. 57 ustawy Pzp.

2.2. Formularz ofertowy – zał. nr 3 do SWZ;

2.3. Formularz cenowy dla oferowanych pakietów – zał. 5 do SWZ

2.4. Oświadczenie o niepodleganiu wykluczeniu na podstawie art. 5k Rozporządzenia 833/2014 (...) – zał. nr 6 do SWZ.

3.Wykaz podmiotowych środków dowodowych na potwierdzenie spełniania warunków udziału w postępowaniu oraz braku podstaw wykluczenia wymaganych do złożenia przez Wykonawcę (w odpowiedzi na wezwanie Zamawiającego w trybie art. 126.1. ustawy Pzp), którego oferta została najwyżej oceniona:

3.1. W celu potwierdzenia braku podstaw wykluczenia:

3.1.1. informacja z Krajowego Rejestru Karnego w zakresie art. 108 ust 1 pkt 1), 2) i 4) ustawy Pzp, sporządzona nie wcześniej niż 6 miesięcy przed jej złożeniem,

3.1.2. oświadczenie w zakresie art. 108 ust. 1 pkt 5) ustawy Pzp, o braku przynależności do tej samej grupy kapitałowej (...) - zał. nr 7 do SWZ – dotyczy pakietu nr…..,

3.1.4. oświadczenie o aktualności informacji zawartych w oświadczeniu, o którym mowa w art. 125 ust 1 ustawy, oraz Rozdziale XV pkt. 1.4 SWZ w zakresie podstaw wykluczenia i spełnienia warunku udziału – wg zał. nr 8 do SWZ.

3.2. W celu potwierdzenia spełnienia warunków udziału w postępowaniu:

3.2.1. Aktualne zezwolenie GIF na prowadzenie hurtowni farmaceutycznej – dotyczy wszystkich pakietów;

3.2.2. Aktualne zezwolenie na obrót środkami odurzającymi i substancjami psychotropowymi wydanego przez Głównego Inspektora Farmaceutycznego (GIF) – dotyczy pakietów: 32-35.

Jeżeli Wykonawca ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczpospolitej Polskiej, zamiast dokumentów o których mowa w pkt 3.1.1. składa informację z odpowiedniego rejestru, takiego jak rejestr sądowy, albo, w przypadku braku takiego rejestru, inny równoważny dokument wydany przez właściwy organ sądowy lub administracyjny kraju, w którym wykonawca ma siedzibę lub miejsce zamieszkania, w zakresie, o którym mowa w art. 108 ust 1 pkt 1), 2) i 4) ustawy Pzp.

  1. Środki ochrony prawnej przysługują Wykonawcy, a także innemu podmiotowi, jeżeli ma lub miał interes w uzyskaniu zamówienia oraz poniósł lub może ponieść szkodę w wyniku naruszenia przez Zamawiającego przepisów Pzp.
  
  2. Środki ochrony prawnej wobec ogłoszenia o zamówieniu oraz SWZ przysługują również organizacjom wpisanym na listę, o której mowa w art. 469 pkt 15) ustawy Pzp, oraz Rzecznikowi Małych i Średnich Przedsiębiorców.
  
  3. Odwołanie przysługuje na:
  
  3.1. niezgodną z przepisami ustawy czynność Zamawiającego, podjętą w postępowaniu o udzielenie zamówienia, w tym na projektowane postanowienie umowy;
  
  3.2. zaniechanie czynności w postępowaniu o udzielenie zamówienia, do której Zamawiający był obowiązany na podstawie ustawy.
  
  4. Odwołanie wnosi się̨ do Prezesa Krajowej Izby Odwoławczej.
  
  5. Na orzeczenie Krajowej Izby Odwoławczej oraz postanowienie Prezesa Krajowej Izby Odwoławczej, o którym mowa w art. 519 ust. 1 Pzp, stronom oraz uczestnikom postępowania odwoławczego przysługuje skarga do sądu. Skargę̨ wnosi się̨ do Sądu Okręgowego w Warszawie za pośrednictwem Prezesa Krajowej Izby Odwoławczej.
