    Zamawiający uzna warunek za spełniony, jeżeli Wykonawca wykaże, że posiada:
    
    - zezwolenie uprawniające do obrotu produktami leczniczymi wydane przez Głównego Inspektora Farmaceutycznego, zgodnie z ustawą Prawo Farmaceutyczne z dnia 6 września 2001 r. W przypadku hurtowni spoza RP nieposiadających zezwolenia uprawniającego do obrotu produktami leczniczymi wydanego przez Głównego Inspektora Farmaceutycznego wymagane jest zaświadczenie wydane przez Głównego Inspektora Farmaceutycznego o możliwości zaopatrywania Aptek Szpitalnych podmiotów leczniczych w produkty lecznicze lub zezwolenie uprawniające do obrotu produktami leczniczymi wydane przez odpowiedni organ państwa członkowskiego UE/EFTA.

  Zastosowano art. 138 ust. 2 pkt 2 do przeprowadzenie postępowania przetargowego na produkty lecznicze, które mogą być stosowane i rozliczane jako PL od 01.07.2023, czyli leków dla których Zamawiający nie mógł przewidzieć zwiększonego zużycia i tym samym skrócono termin składania ofert do 15 dni. Pilna potrzeba udzielenia zamówienia i skrócenie terminu składania ofert wynika z konieczności zagwarantowania ciągłości realizacji umów oraz pilnej potrzeby realizacji umów nowo zawartych przez UCK WUM z NFZ na realizację programów lekowych. Brak przedmiotowych produktów leczniczych w Szpitalu UCK WUM CSK i DSK uniemożliwi realizację zawartych zobowiązań. Istnieje pilna potrzeba zastosowania i wykorzystywania przedmiotowych leków przez Oddziały CSK oraz DSK. Obecność produktów leczniczych na listach refundacyjnych MZ umożliwia skrócenie czasu przygotowania ofert i tym samym nie powinno wpłynąć na konkurencyjność postępowania.
