        1.Zamawiający nie wymaga wniesienia wadium.
        
        2. Zamawiający nie przewiduje udzielenia zamówień, o których mowa w art. 214 ust. 1 pkt 8 ustawy Pzp.
        
        3.Do oferty Wykonawca zobowiązany jest dołączyć aktualne na dzień składania ofert oświadczenie, że nie podlega wykluczeniu i spełnia warunek udziału w postępowaniu. Przedmiotowe oświadczenie Wykonawca składa w formie Jednolitego Europejskiego Dokumentu Zamówienia (ESPD), sporządzonego zgodnie ze wzorem standardowego formularza określonego w rozporządzeniu Wykonawczym Komisji (EU) 2016/7 z dnia 5 stycznia 2016 r. ustanawiającego standardowy formularz jednolitego europejskiego dokumentu zamówienia stanowiący – załącznik nr 3 do SWZ oraz oświadczenie – załącznik nr 3a do SWZ. Informacje te stanowią wstępne potwierdzenie, że Wykonawca nie podlega wykluczeniu z postępowania oraz spełnia warunek udziału w postępowaniu.
        
        4. Przedmiotowe środki dowodowe. Do Oferty Wykonawca zobowiązany jest dołączyć:
        
        4.1 Oświadczenie stwierdzające posiadanie pozwolenia na dopuszczenie do obrotu – jako produkt leczniczy – wydane przez uprawniony do tego organ – (dotyczy Pakietów od 1 do 4, Pakietów od 6 do 19, w przypadku Pakietu 5 – jeżeli dotyczy);
        
        4.2 Oświadczenie Wykonawcy, że zobowiązuje się, w trakcie realizacji umowy, dostarczać na żądanie Zamawiającego certyfikat analityczny, wydany przez uprawniony do tego podmiot – (w przypadku Pakietu 5 – jeżeli dotyczy);
        
        4.3 Oświadczenie stwierdzające posiadanie charakterystyki produktów leczniczych – (dotyczy Pakietów od 1 do 4, Pakietów od 6 do 19, w przypadku Pakietu 5 – jeżeli dotyczy);
        
        Dokumenty sporządzone w języku obcym muszą być składane wraz z tłumaczeniem na język polski.
        
        Zamawiający przewiduje uzupełnienie przedmiotowych środków dowodowych.
        
        5. Pozostałe dokumenty i oświadczenia jakie musi zawierać oferta Wykonawcy.

        11. Zamawiający nie przewiduje obowiązku odbycia przez Wykonawcę wizji lokalnej lub sprawdzenia przez Wykonawcę dokumentów niezbędnych do realizacji zamówienia, o których mowa w art. 131 ust. 2 ustawy Pzp
        
        12. Ochrona danych osobowych. Zgodnie z art. 13 ust. 1 i 2 rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (Dz. Urz. UE L 119 z 04.05.2016, str. 1), dalej „RODO”, Zamawiający informuje, że:
        
        1) administratorem przekazanych przez Wykonawcę danych osobowych jest Kujawsko
        
        -Pomorskie Centrum Pulmonologii w Bydgoszczy, ul. Seminaryjna 1, 85-326 Bydgoszcz;
        
        2) kontakt z Inspektorem Ochrony Danych Kujawsko-Pomorskiego Centrum Pulmonologii
        
        w Bydgoszczy: e-mail: iodo@kpcp.pl;
        
        3) przekazane w związku prowadzonym w myśl ustawy Prawo zamówień publicznych
        
        z dnia 11 września 2019 r. postępowaniem o udzielenie zamówienia publicznego, dane osobowe przetwarzane są na podstawie art. 6 ust. 1 lit. c RODO w celu udokumentowania przeprowadzonego postępowania o udzielenie zamówienia publicznego, a także realizacji umowy;
        
        4) odbiorcami przekazanych przez Wykonawcę danych osobowych będą osoby lub podmioty, którym udostępniona zostanie dokumentacja postępowania w oparciu o art. 18 oraz art. 74 ust. 1 ustawy z dnia 11 września 2019 r. – Prawo zamówień publicznych, dalej „ustawa Pzp”, a także osoby wykonujące w imieniu Zamawiającego czynności związane z prowadzeniem postępowania, a następnie realizacją zawartej umowy;
        
        5) przekazane przez Wykonawcę dane osobowe będą przechowywane, zgodnie
        
        z art. 78 ust. 1 ustawy Pzp, przez okres 4 lat od dnia zakończenia postępowania o udzielenie zamówienia, ponadto w odniesieniu do umów okres ich przechowywania określa Instrukcja Archiwalna KPCP zatwierdzona przez Archiwum Państwowe w Bydgoszczy;
        
        6) obowiązek podania przez Wykonawcę będącego osobą fizyczną oraz osoby fizyczne reprezentujące Wykonawcę danych osobowych jest wymogiem ustawowym określonym w przepisach ustawy Pzp, związanym z udziałem w postępowaniu o udzielenie zamówienia publicznego; konsekwencje niepodania określonych danych wynikają z ustawy Pzp;
        
        7) w odniesieniu do przekazanych przez Wykonawcę danych osobowych decyzje nie będą podejmowane w sposób zautomatyzowany, stosowanie do art. 22 RODO;
        
        8) osoba, której dane dotyczą posiada:
        
        − na podstawie art. 15 RODO prawo dostępu do danych osobowych;
        
        − na podstawie art. 16 RODO prawo do sprostowania danych osobowych*;
        
        − na podstawie art. 18 RODO prawo żądania od administratora ograniczenia przetwarzania danych osobowych z zastrzeżeniem przypadków, o których mowa w art. 18 ust. 2 RODO **;
        
        − prawo do wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych;
        
        9) osobie, której dane dotyczą nie przysługuje:
        
        − prawo do usunięcia danych osobowych;
        
        − prawo do przenoszenia danych osobowych, o którym mowa w art. 20 RODO;
        
        − prawo sprzeciwu wobec przetwarzania danych osobowych.
        
        *Wyjaśnienie: skorzystanie z prawa do sprostowania nie może skutkować zmianą wyniku postępowania o udzielenie zamówienia publicznego ani zmianą postanowień umowy w zakresie niezgodnym z ustawą Pzp oraz nie może naruszać integralności protokołu oraz jego załączników.
