        O udzielenie zamówienia może się ubiegać Wykonawca, który nie podlega wykluczeniu z postępowania w okolicznościach, o których mowa w:
        
        a) Art. 108 ust. 1 ustawy Pzp
        
        b) Art. 109 ust. 1 pkt 1) ustawy Pzp
        
        c) Art. 109 ust. 1 pkt 4) ustawy Pzp,
        
        d) ustawie z dnia 7 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego,
        
        e) Art. 5 k Rozporządzenia 833/2014 w brzmieniu nadanym Rozporządzeniem Rady (UE) 2022/576 z dnia 8 kwietnia 2022 r. w sprawie zmiany Rozporządzenia (UE) nr 833/2014 dotyczącego środków ograniczających w związku z działaniami Rosji destabilizującymi sytuację na Ukrainie.
        
        2. Wykaz dokumentów, które należy złożyć w postępowaniu i zasady ich składania zostały określone w SWZ.
        
        3. Zamawiający wymaga złożenia przez wykonawców zagranicznych dokumentów określonych w SWZ (rozdział IV).
        
        4. Zasady wspólnego ubiegania się o udzielenie zamówienia określa SWZ (rozdział III).
        
        5. Postępowanie prowadzone jest w oparciu o art. 132 Ustawy z dnia 11 września 2019 r. Prawo zamówień publicznych, w trybie przetargu nieograniczonego z zastosowaniem art. 139. Oznacza to, że Zamawiający najpierw dokona badania i oceny ofert, a następnie dokona kwalifikacji podmiotowej wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu.
        
        6. Komunikacja między zamawiającym a wykonawcami, w tym oferty oraz wszelkie oświadczenia, wnioski (w tym o wyjaśnienie treści SWZ, zawiadomienia i informacje przekazywane są wyłącznie w formie elektronicznej za pośrednictwem platformy portal SmartPZP pod adresem:https://portal.smartpzp.pl/spszozzdroje.
        
        Zamawiający odstępuje od wymogu komunikacji elektronicznej wyłącznie w zakresie złożenia wymaganych próbek oferowanych produktów. Próbki należy złożyć za pośrednictwem operatora pocztowego w rozumieniu ustawy z dnia 23 listopada 2021 r. – Prawo pocztowe, osobiście lub za pośrednictwem posłańca na adres zamawiającego w sposób opisany w rozdziale VI, dziale III, pkt. 3, ppkt 5).
        
        7. Zamawiający przewiduje możliwość zmiany umowy w przypadkach określonych w SWZ.
        
        8. Na potwierdzenie, że oferowane dostawy spełniają określone przez zamawiającego wymagania - zgodnie z art. 106 ust. 1 ustawy Pzp - Zamawiający żąda złożenia wraz z ofertą przedmiotowych środków dowodowych, o których mowa SWZ (rozdział VI, dział III). Ww. oświadczenie, dowody i inne dokumenty należy złożyć w oryginale lub kopii potwierdzonej za zgodność z oryginałem (w postaci dokumentu opatrzonego podpisem kwalifikowanym) lub w elektronicznej kopii dokumentu / oświadczenia poświadczonej za zgodność z oryginałem). Jeżeli wykonawca nie złoży przedmiotowych środków dowodowych lub złożone przedmiotowe środki dowodowe będą niekompletne, zamawiający – zgodnie z art. 107 ust 2 ustawy Pzp – wezwie wykonawcę do ich złożenia lub uzupełnienia w wyznaczonym terminie. Zamawiający – zgodnie z art. 107 ust 4 ustawy Pzp – może żądać od wykonawców wyjaśnień dotyczących treści przedmiotowych środków dowodowych.
