         Zamawiający przewiduje możliwość istotnych zmian postanowień zawartej umowy w przypadku wystąpienia co najmniej jednej z okoliczności wymienionych w SWZ. Zmiany mogą dotyczyć terminu realizacji zamówienia, sposobu jego realizacji, a także wynagrodzenia Wykonawcy. Zmiana wymaga aneksu w formie pisemnej. Szczegóły dotyczące warunków realizacji umowy zawiera wzór umowy stanowiący załącznik do SWZ.

      Zamawiający musiał wziąć pod uwagę stan pól i dostosować do tych warunków program nawożenia. Ponadto bardzo szybki wzrost cen , oraz znaczący popyt na nawozy powoduje braki magazynowe u dostawców, co za tym idzie trudność w dostawie danego nawozu i dłuższe oczekiwanie na dostawy. Dodatkowo występuje brak możliwości określenia wartości poszczególnych nawozów. Są to okoliczności, na które pomimo działania z należytą starannością Zamawiający nie ma wpływu.

      Zamawiający musi brać pod uwagę warunki agrotechniczne, a zwłaszcza prawidłowy i terminowy harmonogram nawożenia. Dla zapewnienia ciągłości produkcji na dotychczasowym stabilnym wysokim poziomie konieczne zapewnienie odpowiednich ilości nawozów. Dodatkowo wydłużył się czas szacowania wartości zapotrzebowania z powodu braków nawozów na rynku. W związku z powyższym niemożliwe jest przeprowadzenie postępowania przetargowego z dłuższym terminem składania ofert.
