      Art. 138 ust. 2 pkt 2) ustawy Prawo zamówień publicznych. Zamawiający może wyznaczyć termin składania ofert krótszy niż termin określony w ust. 1, nie krótszy jednak niż 15 dni od dnia przekazania ogłoszenia o zamówieniu Urzędowi Publikacji Unii Europejskiej.

      Ze względu na nieskomplikowany charakter przedmiotu zamówienia, Zamawiający po przeanalizowaniu całokształtu okoliczności faktycznych i prawnych towarzyszących rozpatrywanemu zamówieniu, doszedł do wniosku, iż rozstrzygnięcie przedmiotowego postępowania i zawarcie umowy w sprawie zamówienia publicznego w wymaganym terminie, niezbędnym do realizacji zamówienia oraz dotrzymaniem terminu rozpoczęcia realizacji usługi koszenia trawy i usuwania samosiewek na nieruchomościach będących w zasobie OR w Olsztynie w podziale na części z zachowaniem 35 dniowego terminu składania ofert może spowodować zagrożenie w jego realizacji, co w konsekwencji spowoduje brak zabezpieczenia higieniczno-sanitarnego w użytkowanych budynkach.
