Additional information

1. Zamawiający wskazuje, iż stosownie do treści art. 139 ust. 1 ustawy Pzp, najpierw dokona badania i oceny ofert, a następnie dokona kwalifikacji podmiotowej Wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w Postępowaniu.

2. O udzielenie przedmiotowego zamówienia mogą ubiegać się Wykonawcy, którzy nie podlegają wykluczeniu na podstawie:

1) art. 108 ust. 1 ustawy Pzp,

2) art. 109 ust. 1 pkt 1, 4 i 10 ustawy Pzp,

3) art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach

w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (Dz.U. z 2022 r. poz. 835),

4) art. 5k rozporządzenia Rady (UE) nr 833/2014 z dnia 31 lipca 2014 r. dotyczącego środków ograniczających w związku z działaniami Rosji destabilizującymi sytuację

na Ukrainie (Dz. Urz. UE nr L 229 z 31.7.2014, str. 1), w brzmieniu nadanym na mocy art. 1 pkt 23 rozporządzenia Rady (UE) 2022/576 do ww. rozporządzenia Rady (UE) w sprawie zmiany rozporządzenia (UE) nr 833/2014 dotyczącego środków ograniczających w związku z działaniami Rosji destabilizującymi sytuację na Ukrainie (Dz. Urz. UE nr L 111 z 8.4.2022, str. 1).

3. Wykonawca może zostać wykluczony przez Zamawiającego na każdym etapie postępowania o udzielenie zamówienia.

4. Wstępna ocena braku podstaw do wykluczenia odbywa się na podstawie przedłożonego przez Wykonawcę wraz z ofertą oświadczenia, składanego w formie Jednolitego Europejskiego Dokumentu Zamówienia, dalej jako „JEDZ”, o którym mowa w art. 125 ust. 1 ustawy Pzp.

Wzór „JEDZ” przygotowany przez Zamawiającego dla przedmiotowego postępowania (w formacie .xml – do zaimportowania w serwisie ESPD), stanowi Załącznik nr 3 do SWZ.

5. W przypadku, gdy Wykonawca powołuje się na produkty „równoważne” do wyszczególnionych w Specyfikacjach technicznych sprzętu (Załączniki 1.1-1.26), w celu wykazania równoważności, o której mowa w Rozdziale III SWZ, Wykonawca zobowiązany jest złożyć wraz z ofertą w odniesieniu do każdego urządzenia równoważnego z osobna: wypełniony Załącznik nr 1 do SWZ – Specyfikacja Techniczna Sprzętu, stanowiąca Opis Przedmiotu Zamówienia.
