    1. Postępowanie o udzielenie zamówienia sektorowego prowadzone jest w trybie przetargu nieograniczonego na podstawie przepisów ustawy z dnia 11 września 2019 r. (Dz.U. poz. 2019 ze zm.), zwanej dalej ustawą Pzp.
    
    2. Postępowanie jest prowadzone w języku polskim.
    
    3. Obowiązek informacyjny wynikający z artykułu 13 ust. 1 i 2 RODO (UE) spełniono na stronie internetowej PGG S.A. w zakładce RODO.         4. Po przeprowadzaniu aukcji elektronicznej oraz ustaleniu, która z ofert została najwyżej oceniona, Zamawiający zgodnie z art. 126 ustawy Pzp wezwie wykonawcę, który złożył tę ofertę, do przedstawienia JEDZ oraz podmiotowych środków dowodowych.
        
        5. Zamawiający, na podstawie art. 393 ust. 1 pkt 4) ustawy Pzp, odrzuci ofertę, w której udział produktów pochodzących z państw członkowskich Unii Europejskiej, państw, z którymi Unia Europejska zawarła umowy równym traktowaniu przedsiębiorców lub państw, wobec których na mocy decyzji Rady stosuje się przepisy dyrektywy 2014/25/UE, nie przekracza 50%
