Framework agreement for outdoor toys and multi-use games areas
Reference number: Lillestrøm-23/019Lillestrøm Municipality invites tenderers to TED - Open tender contest for a framework agreement for outdoor toys and multi-use games areas.
The administrative contact person for the procurement is Procurements - Carl Henriksen.
The estimated combined purchases over the framework agreement period of four years is NOK 12,000,000. The maximum scope is defined as NOK 15,000,000. The consumption indication is only a guideline and does not obligate the contracting authority.
Description of the procurement"s purpose
The contracting authority must procure playground equipment, multi-use games areas, training equipment and fall mats from a single framework agreement supplier.
In some cases, it may also be relevant to purchase outdoor furniture such as benches, tables, barbecues and fire pits.
Additional services such as assembly of equipment, disassembly and removal of old existing equipment, excavation, moulding and foundation work will be requested in some projects.
In addition, the contracting authority requests consultancy services.

Lillestrøm Municipality, hereinafter called the contracting authority, invites tenderers to TED - Open tender contest for a Framework agreement for outdoor toys and multi-use games areas.
The contracting authority will enter into a framework agreement with one (1) tenderer.
The administrative contact person for the procurement is Procurements - Carl Henriksen.
The contest has been announced in DOFFIN and the TED database – See www.doffin.no.
Justification for cancellation
The contracting authority"s intention with the evaluation of the award criterium "quality" has been to evaluate added fulfilment of the offered products" lifetime and wanted quality.
When going through a received objection, it has become clear that the award criterium "quality", when seen together with the described text in the requirements specification points 1.2.1 to 1.2.24, cannot only be understood that this has been the contracting authority"s intention. In light of the complainant"s objections, a review of the tenders and the evaluation shows that several of the tenderers have misunderstood this intention, and instead understood it as a desire to get confirmation that the set should-requirements can be met.
The award criterium "quality" is therefore not formulated so that is gives a normal attentive tenderer sufficient information on what qualities are relevant for judging the criterium. Nether did the wording in the requirements give a normal attentive tenderer the incentive to describe the delivery in more detail, other than by showing that the requirements were fulfilled.
The award criterium has therefore not been formulated in a sufficiently clear way, and the requirement for predictably is therefore not fulfilled. The criterium is therefore not suitable for identifying the best tender. Based on the above, the award criterium is deemed to be inappropriate and therefore illegal, and there is a duty to cancel the notice, cf. the PPR § 25-4.
