Sykehusinnkjøp HF, Divisjon legemidler (henceforth referred to as SHI) is collecting tenders for medicines that are used by the health authorities. SHI has previously announced and implemented an open tender contest for antibiotic medicines in Nordic tenders. The contests covered various preparations and was announced by Amgros. This contract expires 31 March 2024.

The contract for benzylpenicillin J01CE01 was not extended as intended up until the next tender start, and the substance was taken out of the Nordic tender. A contest will be announced with a start-up 1 April 2025, but until then a contract will be signed with PanPharma as there are no competitors in the market up until the next tender.

Sykehusinnkjøp HF, Divisjon legemidler (henceforth referred to as SHI) is collecting tenders for medicines that are used by the health authorities. SHI has previously announced and implemented an open tender contest for antibiotic medicines together with Amgros. The contest also covered Benzylpenicillin J01CE01.

We are without a contract for the period 1 April 2024 - 31 March 2025. There is a need to enter into a contract.

Based on this, SHI intends to enter into contracts between the regional health authorities and PanPharma, as a contract to 2301a-2 in the above period. The health trusts that are under the regional health authorities have options to join the contracts. The same applies for non-profit institutions/hospitals with an operational contract with each health region.

SHI has explored the market situation and is of the opinion that it is not possible to hold a new contest, or that a supplier other than PanPharma can deliver the product in the current contract period, and that the situation that has occurred is not the contracting authority’s fault, nor something that the contracting authority could foresee. SHI therefore believes that there are grounds to make the procurement without an invitation to tender. Refer to the Public Procurement Regulations section 13-4, letter b, no. 3.

If SHI does not receive any objection, the contract will be signed at the end of 10 days after the publication of this notice.

SHI therefore believes that there are grounds to make the procurement without an invitation to tender. See the public procurement regulations §21-5, c.f. § 21-2, c.f. § 13-4 letter b no. 3 and letter cf. also § 13-3 letter e.
