The procurement falls outside the scope of application of the directive

Explanation:

The health trusts in the Western Norway Regional Health Authority intend to procure disposable probes, reusable probes and accompanying accessories for SpO2 measurement. As far as the health trusts are aware, Infiniti AS is the only supplier of disposable and reusable probes from the manufacturer Masimo. The health trusts currently have several monitoring devices from Philips that come with the Masimo algorithm. Only disposable and reusable probes with the Masimo algorithm are compatible with these monitoring devices. It is therefore not possible to enter into an agreement with other suppliers of these products.

Based on this, a call for tenders cannot be implemented, cf. the Public Procurement Regulations § 13-4 letter b, no. 2.
