Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • The procurement falls outside the scope of application of the directive
Explanation:

Trondheim Renholdsverk AS is a governmental body responsible for handling its owner municipalities" statutory responsibilities within household waste, including food waste.

The city council has decided that Trondheim Municipality will award Trondheim Renholdsverk AS, org. no. 988 964 573, the unilateral right to carry out the municipality"s obligations regarding the collection and management of food waste, cf. the Pollution Act §§ 29 and 30. The city county has decided that the unilateral right will commence on 1.6.2023 and last until 31.12.2048. Furthermore, the city council has decided that Trondheim Renholdsverk AS can delegate the unilateral right to other governmental bodies for the treatment of food waste when appropriate for efficient collection, sorting, and further treatment of the waste. Such delegation of the food waste must be time limited. This is in accordance with the Public Procurement Regulations §2-3 and the procurement directive art. 11.

The unilateral right is delegated to ECOPRO a governmental body where Trondheim Renholdsverk AS will invest in the biogas plant with the purpose of ensuring the inhabitants in Trondheim Municipality that we will cover predictable and sustainable solutions for food waste. In order to ensure this aim, as well as ensure continued operation and future investments in ECOPRO, the contract will be signed for 16 years and 6 months from 10.07.2023 to 31.12.2039.

The unilateral right is deemed to be consistent with the EEA agreement. The unilateral right is announced and can be read here:
