Bergen Hospital Trust intends to enter into a contract with BRUKER NORDIC AB for the delivery of MALDI-TOF MS. One instrument will be procured in 2023 and there is an option for one extra instrument. A procurement contract and a framework agreement will be entered into for instrument-dependent consumables with a duration lasting as long as the instruments are in use.

The contracting authority is aware that there are two alternative instruments in the market. One delivered by bioMérieux and the other from Bruker Nordic. Both suppliers presented their instruments to the contracting authority in autumn 2022.

The reason for an option being added for an extra instrument is that the section currently has two instruments that need replacing. One now in 2023. Our two instruments must be from the same supplier due to operating routines, and because the instruments must have the same database.

Based on the mentioned justifications, the Contracting Authority believes that there is a legal basis to enter into a contract for the procurement of a MALDI-TOF MS and the accompanying instrument-dependent consumables with Bruker Nordic AB without announcing a contest, cf. the Public Procurement Regulations § 21-5, c.f. § 13-4 first paragraph, letter b, point 2.
