The procurement falls outside the scope of application of the directive

Explanation:

The reason for making this procurement as a direct procurement is that, as far as the contracting knows, only Swemacimaging NUF can offer mobile biplane x-ray equipment for use in orthopaedic operations. Experience from other tender contests that the Norwegian Hospital Procurement Trust has held in the last year support this.

Terms in the Public Procurement Regulation §13-4 letter b) no. 2. are considered met as the contracting authority is not aware of any other supplier who can fulfil the contracting authority’ need.
