Dat betekent dat de in deze aankondiging bekendgemaakte wijziging pas wordt doorgevoerd nadat de termijn van 20 dagen is verstreken of eventuele klachten in kort geding zijn afgewezen.

De oorspronkelijke indexeringsregeling is tussen concessieverlener en exploitant onverhoopt onwerkbaar gebleken. De exploitant had en heeft geen OTC-jaarpiekprijs en op dat punt is de overeenkomst onduidelijk. Bovendien geldt dat als 1 december op een zaterdag of zondag valt, er überhaupt geen OTC-transacties plaatsvinden, derhalve wordt de bestaande indexeringsregeling vervangen door een gelijkwaardige, verbeterde indexeringsregeling.
