         In 2020 heeft de Aanbestedende dienst, gemeente Molenlanden, meegedaan aan de gezamenlijke aanbesteding “inhuur tijdelijk personeel” regio Zuid-Holland-Zuid. Naar verwachting bereikt de huidige raamovereenkomst van de Aanbestedende dienst, op 1 januari 2024 haar maximale contractwaarde. Om die reden wenst zij voor 1 januari 2024 een nieuwe raamovereenkomst af te sluiten.

         De Aanbestedende dienst wenst voor de duur van tweeënhalf (2,5) jaar een Overeenkomst af te sluiten met één (1) professionele en betrouwbare Ondernemer ten behoeve van de uitvoering voor het inhuren van tijdelijk personeel. De Overeenkomst kent een verlengingsoptie van drie (3) maal, één (1) jaar. Hiermee komt de totale looptijd, inclusief verlengingsopties op vijfeneenhalf (5,5) jaar. Een eventuele verlenging hangt onder andere af van de nog later af te sluiten overeenkomst door de Regio Zuid-Holland-Zuid. De Aanbestedende dienst behoudt de mogelijkheid om daar tussentijds bij aan te sluiten op een later moment.

      In afwijking op artikel 2.140 lid 3 van Gewijzigde Aanbestedingswet 2012 bedraagt de totale duur van de raamovereenkomst inclusief verlengingsopties vijf (5,5) jaar. Deze termijn wordt proportioneel geacht aangezien de Ondernemer mogelijkerwijs benodigde investeringen moet doen aangaande de gevraagde dienstverlening. De Ondernemer moet in staat worden geacht deze investering in een realistische tijdsduur terug te kunnen verdienen. Indien men bezwaar heeft tegen de gestelde langere looptijd van de Overeenkomst, dient men dit voor de uiterlijke datum van indiening inschrijving kenbaar te maken. Deze datum geldt als een vervaltermijn. Dit houdt in dat na deze datum een partij zijn rechten heeft verwerkt om hiertegen nog bezwaar te maken.
