Surf heeft het voornemen om per 1 juli 2023 namens de bij haar aangesloten en deelnemende instellingen een overeenkomst te sluiten ten behoeve van de levering van IBM SPSS licenties. SURF treedt hier op als Independent Software Vendor (ISV) voor de leden.

De overeenkomst heeft een looptijd van 4 jaar. De omvang wordt ingeschat op ongeveer 9 miljoen euro.

    • absence of competition for technical reasons
Explanation:

De aanbestedende dienst verwijst naar een merk. Dit is gerechtvaardigd om 2 redenen: a) De leermiddelenexceptie is van toepassing op een groot deel van de licenties die worden ingekocht. Dit betreft de softwarelicenties die voor het onderwijs worden ingekocht. b) De aard van de raamovereenkomst (en de daaruit voortvloeiende deelopdrachten) rechtvaardigt een beroep op artikel 2.76 Aw, de merkgerichte uitvraag. De technische afhankelijkheid van SPSS is hier aan de orde, hetgeen afzien van een functionele uitvraag rechtvaardigt. Dit geldt zowel voor de licenties ter gebruik in het onderwijs, als ook in het onderzoek. Dan is vervolgens de vraag of de onderhandelingsprocedure zonder aankondiging, als bedoeld in artikel 2.32 Aw, kan worden toegepast. SURF treedt hier op als Independent Software Vendor (ISV) voor de leden. Gelet op het gehanteerde model, waarbij de behoefte van SURF en de instellingen en ook IBM beter wordt ingevuld, is sprake van exclusieve distributierechten voor SURF. Als er nog een reseller bijkomt is er sprake van sub-sub distributie wat niet is toegestaan vanuit IBM. IBM heeft in een sole source verklaring toegelicht waarom een uitvraag aan de reseller hier achterwege dient te blijven.
