VII.2.2)Reasons for modification

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

1. Er moet een noodzaak bestaan tot aanvullende opdrachten: om duurzaamheidsdoelstellingen van Rijkswaterstaat te realiseren is het noodzakelijk om een proefvak 2L-ZOAB 5 aan te leggen met epoxy gemodificeerde bitumen (EMB);

2. Verandering van opdrachtnemer is niet mogelijk om een economische of technische reden, opdrachtnemer voert op deze locatie werkzaamheden uit t.b.v. het prestatiecontract;

3. Verandering van opdrachtnemer leidt tot aanzienlijk ongemak of aanzienlijke kostenstijgingen voor de

aanbestedende dienst;

4. Prijsverhoging als gevolg van de wijziging bedraagt niet meer dan 50% van de oorspronkelijke (geïndexeerde) opdrachtsom. Het bedrag van de wijziging is € 245.771,30 en de opdrachtsom is € 12.900.000
