Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive

Explanation:

De oorlog in Oekraïne blijft een ongekende hoeveelheid leed met zich meebrengen. Nog steeds ontvluchten veel inwoners van Oekraïne het geweld. De gemeenten van Veiligheids- en Gezondheidsregio Gelderland-Midden (VGGM) blijven prioriteit geven aan het realiseren van 3.000 opvangplekken voor Oekraïense vluchtelingen. Ook de gemeente Westervoort neemt met 140 gemeentelijke opvangplekken haar verantwoordelijkheid. Zo wordt voorzien in de meest dringende levensbehoeften van vluchtelingen, zoals huisvesting, voedsel en andere hulpgoederen. Als gevolg van deze acute noodsituatie, die niet voorzienbaar was voor de gemeente en die niet aan haar te wijten is, heeft de gemeente in zeer kort tijdsbestek de nodige inkopen moeten doen en moet zij op korte termijn ook weer nieuwe/aanvullende inkopen doen. Ter zake daarvan was en is het vanwege de aan de orde zijnde dwingende spoed, veroorzaakt door genoemde onvoorziene gebeurtenissen, redelijkerwijs niet mogelijk om een reguliere of zelfs versnelde aanbestedingsprocedure te houden. De gemeente is dan ook van oordeel dat haar ter zake van reeds verrichte en bepaalde nog te verrichten inkopen een beroep toekomt op de onderhandelingsprocedure zonder aankondiging zoals bedoeld in art. 2.32 lid 1 sub c AW.
