Negotiated procedure without prior publication

The works, supplies or services can be provided only by a particular economic operator for the following reason:
- protection of exclusive rights, including intellectual property rights

Explanation:

The Department of Fisheries and Aquaculture relies on the FLUX Transportation Layer Node to collect and transmit fisheries-related information to the European Fisheries Control Agency and Member States. The Department relies on this system to collect, store and display all fisheries-related information.

The specific modules required for this system to operate were developed by Trackwell. Hence, the required support and maintenance and/or enhancements services must be carried out by the original company that developed the modules.

Approval has been granted by the General Contracts Committee to enter into a negotiated contract with Trackwell for the provision of Support and Maintenance Services for Fisheries modules for the Department of Fisheries and Aquaculture at the estimated cost of €149,500 excl VAT for a period of 20 months.

This approval has been granted in terms of Regulation 154 (1) (b) (ii) of the Public Procurement Regulations LN352/2016.
