Description: TENDER TERMS FOR THE SELECTION, BY OPEN PROCEDURE, OF THE IMPLEMENTING BODY OF THE PROMOTION AND INFORMATION PROGRAMME ON EUROPEAN UNION AGRICULTURAL PRODUCTS PURSUANT TO REGULATION (EU) NO. 1144/2014, NAMED: ELPRO: ELIGE PRODUCTOS EUROPEOS. PREMISES CONSORZIO TUTELA PROVOLONE VALPADANA (“Proposing Organisation”), with registered office at Piazza Marconi 3 – Cremona - 26100 Cremona, Italy, VAT No. IT00870400199, tel. +39 0372 30598, email: segreteria@provolonevalpadana.it, certified email: consorziotutelaprovolonevalpadana@legalmail.it, as the proposing organization in the context of the AGRIP-SIMPLE-2026 call for proposals for EU grants for information and promotion measures concerning European agricultural products implemented in the internal market/third countries, intends to submit a three-year information and promotion program, called EL.PRO: ELIGE PRODUCTOS EUROPEOS (the "Program") and therefore INDEX pursuant to the relevant articles of Regulation (EU) No. 1144/2014, Delegated Regulation (EU) No. 1829/2015, and Implementing Regulation (EU) No. 1831/2015, a call for tenders for the selection, through an open comprehensive procedure, of an implementing body ("Implementing Body") responsible for implementing the actions/activities/initiatives aimed at achieving the objectives set out in the Program, which will be submitted pursuant to EU Regulation No. 1144/2014 of the European Parliament and of the Council - Call for proposals - 2026. If approved, the call for proposals will take place in the following target countries: Argentina, URUGUAY, and Brazil. The call for proposals will cover the following products with a Community designation of origin: PROVOLONE VALPADANA PDO – cheese – NC804069073 Economic operators meeting the requirements set out in the above-mentioned EU Regulations, as specified in the following paragraphs, are invited to submit a bid (technical and financial) in strict compliance with the instructions contained in these tender specifications (the "Tender Specifications"). It is hereby clarified that, since this call for proposals is aimed at implementing a promotional program that has yet to be submitted for funding from the aforementioned funds, if the Proposing Organization is not among the proposing organizations selected by the European Research Executive Agency ("REA") under the aforementioned Call for Proposals 2026, the awarding of the services covered by these Terms and Conditions will be deemed null and void. Therefore, in this case, the Proposing Organization will have no obligation, and the bidders will not be entitled to any reimbursement or damages claims. Should the Program be approved, the winning Implementing Organization will be responsible for carrying out the activities envisaged in the Program. The activities to be carried out by the Execution Body include, but are not limited to: public relations, traditional and digital media campaigns, events and trade fairs, tastings, and the production of informational and promotional materials, as detailed in these Terms and Conditions. The relationship between the Execution Body and the Proposing Organization will be governed by a specific service contract (the "Contract"). In general, the Execution Body, in addition to carrying out the agreed-upon activities, will also prepare financial and operational reporting, making available to the Proposing Organization proof of payment for expenses incurred, as well as all documentation and information related to the activities carried out (e.g., geolocalized photos, data on results achieved, participant lists, any video recordings, descriptions of the activities performed, and other matters that will be further specified in the service contract). Please note that the Proposing Organization is not a public law body pursuant to Article 2, paragraph 1, point 4, of Directive 2014/24/EU and, therefore, as indicated in the aforementioned legislation, is not required to apply the national provisions implementing the European Directives on public procurement (in Italy, Legislative Decree 36/2023). Directive 2014/24/EU and Legislative Decree 36/2023 (the "Public Procurement Code" or the "Code") will therefore be applicable only if and to the extent expressly referred to in the Tender Specifications and related annexes.
