         Perkančioji organizacija reikalauja, kad tiekėjai pateiktų Europos bendrąjį viešųjų pirkimų dokumentą EBVPD - aktualią redakciją, pakeičiančią kompetentingų institucijų išduodamus dokumentus ir preliminariai patvirtinančią, kad nėra tiekėjo pašalinimo pagrindų, nustatytų, vadovaujantis Viešųjų pirkimų įstatymo 46 str. nuostatomis. EBVPD parengiamas pagal standartinę formą, kuri patvirtinta 2016 m. sausio 5 d. Komisijos įgyvendinimo reglamentu (ES) 2016/7, kuriuo nustatoma EBVPD standartinė forma (OL 2016L 3, p. 16). Norintieji pildyti EBVPD elektroniniu būdu, turi naudotis Europos Komisijos sukurta elektronine forma.

         Perkančiajai organizacijai atlikus EBVPD patikrinimo procedūrą, patikrinus pasiūlymus ir išrinkus galimą laimėtoją, tik jo bus prašomi dokumentai, patvirtinantys pašalinimo pagrindų nebuvimą.

         1.Jei Tiekėjas ne dėl Pirkėjo kaltės nepristato, nesumontuoja, neįdiegia techninę specifikaciją atitinkančių Prekių ir (ar) neapmoko Pirkėjo personalo nustatytu terminu, Pirkėjas turi teisę be oficialaus įspėjimo ir nesumažindamas kitų savo teisių gynimo būdų pradėti skaičiuoti 0,05 proc. dydžio delspinigius nuo laiku nepatiektų Prekių kainos už kiekvieną termino praleidimo dieną, bet ne ilgiau kaip 60 dienų nuo termino praleidimo dienos. Pirkėjas turi teisę išskaičiuoti netesybų sumą iš Tiekėjui mokėtinų sumų. Pirkėjas neprivalo įrodyti Tiekėjui, kad patyrė nuostolių.

         2. Pirkėjui vienašališkai nutraukus Sutartį ar jos dalį dėl esminio Sutarties ar jos dalies pažeidimo, Tiekėjas įtraukiamas į Nepatikimų tiekėjų sąrašą, taip pat Tiekėjas sumoka Pirkėjui 10 proc. dydžio netesybas (baudą) nuo pradinės sutarties vertės be PVM arba nuo konkrečios pirkimo dalies vertės be PVM, nurodytos Sutarties priede.
