Assignment Title: Consultant to training in Case preparation and Court proceedings.

Reference No: KI-MFMRD-442105-CS-INDV.

The Ministry of Fisheries and Marine Resources Development has received financing from the World Bank toward the cost of the Pacific Regional Oceanscape Program (PROP) Project and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) will to ensure a comprehensive understanding by fisheries officers of their role as witnesses in case proceedings. The role of fisheries officers can be both as officers involved in a prosecution in which they were involved, and/or as experts in any element of fisheries or fishing operations. For example, from fish identification and catch recording, to describing fishing operations, to the operation of navigation and other electronic equipment especially regarding position fixing and the operation of vessel monitoring systems.

Building on an understanding of the foundations of the international and domestic legal frameworks for fisheries MCS, and combating IUU fishing, this process starts with identifying what evidence might be required at the pre-inspection planning stage for enforcement operations, planned interview techniques, note taking, statement preparation for suspects and witnesses, preparation of contemporaneous notes by officers and observers, identification, seizure, collection and storage of physical evidence, and chain of custody requirements. It continues with understanding how to present this information in a manner that can be readily understood by judicial officers and lay juries in a compelling manner, and the development of skills to effectively deal with cross examination competently and professionally.

The Ministry of Fisheries and Marine Resources Development now invites eligible individual Consultant (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services (attach curriculum vitae with description of experience in similar assignments, similar conditions, etc.). Firms’ staff may express interest through the employing firm for the assignment and, under such situation, only the experience and qualifications of individuals shall be considered in the selection process. The criteria for selecting the Consultant are:

Qualification requirement for Consultant:

  • Masters’ level qualifications in the Law of the Sea, Criminal Law, Environment Law and International Relations or a very high levels of widely recognised equivalent expertise.

Advanced Level (minimum five years of applied experience)

  • Broad experience in training and capacity building in MCS system and IUU fishing compliance operations, with a particular focus on prosecutions and court preparation.
  • Strong appreciation of the relevant work and requirements of SPC, FFA, and the WCPFC.
  • Understanding of relevant cultural considerations.
  • Extensive experience working in the Pacific region.

The support consultant must have a minimum of five years’ work experience in one or more key areas of the Activity.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the “Procurement Regulations for IPF Borrowers” September 2023 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. In addition, please refer to the following specific information on conflict of interest related to this assignment as per paragraph 3.17 of the Procurement Regulations on link www.worldbank.org .
