         a) non si trovino nelle situazioni di esclusione di cui all’artt. 94, 95 e 98 del D.Lgs. 36/2023 e/o nelle condizioni di incapacità a contrarre con la Pubblica Amministrazione in riferimento alla vigente normativa antimafia e/o non aver affidato incarichi in violazione dell’art. 53, comma 16ter, del D.Lgs 165/2001;

         b) siano in regola con quanto previsto dalla Legge 18.10.2001, n. 383 e s.m.i. e dal D.L. 25.09.2002, n. 210, convertito con Legge 22.11.2002, n. 266, se ed in quanto applicabile;

         c) siano iscritte nel registro della Camera di Commercio, Industria, Artigianato e Agricoltura o ad eventuali corrispondenti albi negli Stati di residenza per le Ditte straniere aventi sede in uno stato della UE, alle condizioni previste all’art. 100 del D.Lgs. 36/2023;

         d) siano in possesso delle autorizzazioni, comunque denominate, prescritte dalle vigenti normative in materia di fornitura/commercializzazione di gas naturale;
