        - L"Amministrazione si riserva la facoltà di prorogare il contratto, per una durata non superiore a 12 mesi, ai prezzi, patti e condizioni stabiliti nel contratto ovvero alle condizioni di mercato ove più favorevoli per la stazione appaltante, ai sensi dell"art. 120, comma 10 del D.Lgs. 36/2023.

        - La durata del contratto di appalto potrà essere modificata, per il tempo strettamente necessario alla conclusione delle procedure necessarie per l"individuazione del nuovo contraente, se si verificano le condizioni indicate all"art. 120, comma 11 del D.Lgs. 36/2023. In tal caso il contrente è tenuto all"esecuzione delle prestazioni oggetto del contratto agli stessi -o più favorevoli- prezzi, patti e condizioni.

        - Con riferimento all"art. 120, comma 9 del D.Lgs. 36/2023, qualora in corso di esecuzione si renda necessario un aumento o una diminuzione delle prestazioni fino a concorrenza del quinto dell"importo del contratto, l"Amministrazione può imporre all"appaltatore l"esecuzione alle condizioni originariamente previste. In tal caso l"appaltatore non può fare valere il diritto alla risoluzione del contratto.

        - Con riferimento all’art. 120, comma 1, lett. a) del D.lgs. n. 36/2023, l"Amministrazione si riserva di richiedere all’Ente gestore un’ulteriore variazione delle prestazioni contrattuali, anche superiore al quinto d’obbligo e nei limiti del 50% dell’importo del contratto nei termini stabiliti nel Disciplinare e nello Schema di Contratto.

        L"Amministrazione può procedere a modificare il contratto, anche nei seguenti casi:

        - al ricorrere delle condizioni di cui all’art. 120, comma 5 del D.Lgs. n. 36/2023;

        - al ricorrere delle condizioni di cui all’art. 120 comma 3 del D.Lgs. n. 36/2023.
