        1) A richiesta della stazione appaltante, si potrà proporre alla ditta appaltatrice di rinnovare il contratto per il periodo di ulteriori 3 anni (36 mesi);

        2) In casi eccezionali, il contratto in corso di esecuzione può essere prorogato per il tempo strettamente necessario alla conclusione della procedura di individuazione del nuovo contraente se si verificano le condizioni indicate all’articolo 120, comma 11, del Codice. In tal caso il contraente è tenuto all’esecuzione delle prestazioni oggetto del contratto agli stessi prezzi, patti e condizioni previsti nel contratto;

        3) Variazione fino a concorrenza del quinto dell’importo del contratto: qualora in corso di esecuzione si renda necessario un aumento o una diminuzione delle prestazioni fino alla concorrenza del quinto dell"importo del contratto, la stazione appaltante può imporre all"appaltatore l"esecuzione alle condizioni originariamente previste ai sensi dell’art. 120, comma 9, del D. Lgs. 36/2023 e s.m.i. . In tal caso l"appaltatore non può fare valere il diritto alla risoluzione del contratto;

        4) Modifiche del contratto ai sensi dell’articolo 120, comma 1, lettere a) e b) del Codice: la stazione appaltante si riserva di modificare il contratto in corso di esecuzione, nei casi in cui dovessero sorgere esigenze operative, tali da richiedere una modifica ai sensi della normativa vigente.
