        La stazione appaltante si riserva la facoltà di rinnovare il contratto, alle medesime condizioni, per per l’anno 2025 per le gare “POLIMIRUN SPRING 2025”, “POLIMIRUN WINTER 2025” e “POLIMIRIDE 2025”, per un importo massimo di € 310.000,00, al netto di Iva e/o di altre imposte e contributi di legge, nonché degli oneri per la sicurezza dovuti a rischi da interferenze.

        Modifiche del contratto ai sensi dell’articolo 120, comma 1, lettera a) del Codice: la stazione appaltante si riserva di modificare il contratto in corso di esecuzione, nei seguenti casi:

        - L’importo massimo previsto per la richiesta di eventuali ulteriori servizi e attrezzatture opzionali e non garantiti in alcun modo, ai sensi dell’art. 120 c.1 D.lgs 36/2023, è pari ad € 88.000,00 per l’intera durata contrattuale.

        Le modalità ed i prezzi per l’attivazione della modifica contrattuale sono riportati nel Capitolato agli art. 2.2 e 2.3.

        - Sono previsti inoltre € 20.000,00 IVA quale importo opzionale non garantito, ai sensi dell’art. 120 c.1 D.lgs 36/2023, relativo agli eventuali oneri legati alla creazione, da parte della Questura di competenza, del piano di sicurezza e antiterrorismo al fine di per garantire alti livelli di sicurezza in occasione di manifestazioni pubbliche. L’ammontare definitivo degli oneri verrà comunque determinato a misura, dal computo delle prestazioni effettivamente eseguite.

        Variazione fino a concorrenza del quinto dell’importo del contratto: qualora in corso di esecuzione si renda necessario un aumento o una diminuzione delle prestazioni fino alla concorrenza del quinto dell"importo del contratto, la stazione appaltante può imporre all"appaltatore l"esecuzione alle condizioni originariamente previste. In tal caso l"appaltatore non può fare valere il diritto alla risoluzione del contratto. Tale opzione troverà copertura economica nell’importo dedicato ad eventuali ulteriori servizi e attrezzatture opzionali e non garantiti.
