3. Section III
   1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
         List and brief description of conditions:

         A valere per singolo Lotto:

         a) inesistenza delle condizioni di esclusione di cui agli artt. 94, 95 e 98 D.Lgs 36/2023;

         b) iscrizione nel Registro delle Imprese tenuto dalla Camera di Commercio Industria, Artigianato e Agricoltura (o in uno dei registri professionali o commerciali dello Stato di residenza se si tratta di uno Stato dell"U.E., in conformità a quanto previsto dall’art. 100/Requisiti di ordine speciale, comma 3 del D.Lgs. n. 36/2023) per un’attività pertinente anche se non coincidente con l’oggetto dell’appalto. All’operatore economico di altro Stato membro non residente in Italia è richiesto di dichiarare ai sensi del decreto del Presidente della Repubblica del 28 dicembre 2000, n. 445 di essere iscritto in uno dei registri professionali o commerciali di cui all’Allegato II.11 del Codice;

         c) i) iscrizione all’Albo Trasportatori conto terzi ex art. 12 legge 298/1974 e s.m.i.;

         oppure in alternativa:

         ii) possesso della licenza per Trasporto Merci Conto Proprio da parte dell’OE concorrente

         oppure in alternativa:

         iii) ai sensi di quanto previsto dall’art. 119, c. 3, lett. d) del D.Lgs. n. 36/2023, è possibile ricorrere a contratti continuativi di cooperazione a favore di soggetti dotati della iscrizione di cui alla lettera i) aventi data anteriore all’indizione della presente procedura di gara, da depositarsi presso la Stazione Appaltante prima della sottoscrizione dell’Accordo Quadro;

         oppure in ulteriore alternativa:

         (iv) è consentita la dimostrazione del possesso del requisito di cui alla lettera c) anche mediante subappalto obbligatorio a favore di operatore economico in possesso della iscrizione di cui alla lettera i).
