      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        a) iscrizione nel registro tenuto dalla Camera di commercio industria, artigianato e agricoltura oppure nel registro delle commissioni provinciali per l’artigianato per attività coerenti con quelle oggetto della presente procedura di gara.

        Il concorrente non stabilito in Italia ma in un altro Stato Membro o in uno dei Paesi di cui all"articolo 83, comma 3 del Codice, presenta dichiarazione giurata o secondo le modalità vigenti nello Stato nel quale è stabilito;

        b) di possedere l’autorizzazione rilasciata dall’ISVAP – oggi IVASS - all’esercizio in Italia nei rami assicurativi relativi al/i lotto/i cui si intende partecipare.

        Per le Imprese aventi sede legale in un altro Stato membro dell’U.E. :

        - di aver ricevuto la comunicazione (o il silenzio assenso) di cui all’art. 23 – comma 4 - del D.Lgs. n. 209/05 e s.m.i., che permette di operare in regime di stabilimento sul territorio della Repubblica Italiana nei rami assicurativi relativi al/i lotto/i cui si intende partecipare, per il tramite di una propria sede secondaria;

        oppure

        - di aver ricevuto la comunicazione di cui all’art. 24 – comma 2 - del D.Lgs. n. 209/05 e s.m.i., che permette di operare in regime di libertà di prestazione sul territorio della Repubblica Italiana nei rami assicurativi relativi al/i lotto/i cui si intende partecipare;

        Le Imprese aventi sede legale in un altro stato membro dell’U.E. possono partecipare in regime di stabilimento nel territorio della Repubblica Italiana, ai sensi dell’art. 23 del D.Lgs. n. 209 del 2005, nel rispetto del comma 4 dello stesso articolo, per i rami assicurativi oggetto del presente appalto. La partecipazione è ammessa esclusivamente per il tramite della propria Rappresentanza Generale della sede secondaria operante in Italia.

        Le Imprese aventi sede legale in un altro stato membro dell’U.E. possono, altresì partecipare in regime di libertà di prestazione di servizi nel territorio della Repubblica Italiana, ai sensi dell’art. 24 del D.Lgs. N. 209 del 2005.
