Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

A seguito della saturazione del 6/5, si rende necessario concludere un Atto Integrativo dell’Accordo Quadro, il quale ha una capienza residua insufficiente rispetto alle esigenze di Trenitalia. Ai sensi dell’art. 106 c. 1 lettera b del D.lgs 50/2016 si tratta di servizi supplementari che si sono resi necessari durante il periodo di efficacia contrattuale e non erano inclusi nell"appalto iniziale, ove un cambiamento del contraente produrrebbe entrambi i seguenti effetti:1) risulti impraticabile per motivi economici o tecnici quali il rispetto dei requisiti di intercambiabilità o interoperabilità tra apparecchiature, servizi o impianti esistenti forniti nell"ambito dell"appalto iniziale;2) comporti per l"amministrazione aggiudicatrice o l"ente aggiudicatore notevoli disguidi o una consistente duplicazione dei costi.
