        L"accordo quadro potrà essere modificato, senza una nuova procedura di affidamento, ai sensi dell"art. 106, comma 1, lett. a) del Codice, anche in ragione di aumento/decremento dei flussi, per quanto attiene al numero dei migranti cui dare accoglienza per un limite massimo del 50 % dei posti contrattualizzati. Resta fermo, in ogni caso, quanto previsto dall"art. 106, comma 12, del D.Lgs. 50/2016 relativamente al quinto d"obbligo.

        La durata dell"accordo quadro in corso di esecuzione, potrà essere modificata per il tempo strettamente necessario alla conclusione delle procedure necessarie per l"individuazione del nuovo contraente ai sensi dell"art. 106, comma 11 del D.Lgs. 50/2016. In tal caso il contraente è tenuto all"esecuzione delle prestazioni oggetto del contratto agli stessi — o più favorevoli — prezzi, patti e condizioni.
