Clare County Council intend to develop and enhance the amenity value of the existing town park by undertaking a programme of works that will result in the provision of a new Town Park. This will include a number of different amenity zones which will incorporate a network of paths, including amenity grassland areas, an activity area incorporating an adventure play area, a pump track, a bandshell and multiple seating areas.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

During the latter stages of the project additional works were considered necessary for the completion of the project. The necessary works were required as there were a number of issues that arose, which can be summarised under the following 3 headings Drainage Security and Health and Safety Landscaping

VII.2.2)Reasons for modification

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Economic Reasons. There would have been no savings to the Council had the additional works been tendered separately and would most likely have incurred greater cost to the Council. The Council incurred additional cost and delay for the project due to the retendering process required following the original contractor going into administration. Between the first November 2017 and second August 2018 tender competition for this project there was a significant escalation in construction costs of 21%. Therefore it was economically favourable for the additional works to be undertaken by the main contractor. Technical Reasons. Extra works were required to address issues relating to drainage, security and health and safety and landscaping. The additional security requirements were necessary to prevent damage to the park and park installations..Park closure for an unreasonable length of time would result in Significant Inconvenience and Substantial Duplication of costs were also factors.
