Following the completion of the Procurement Process, the NPHDB was unable to enter a contract with the preferred tenderer. As the NPHDB only received tenders that were unsuitable within the meaning of Regulation 32(4) of the European Union (Award of Public Authority Contracts) Regulations 2016 (the “2016 Regulations”), the NPHDB intends to use a negotiated procedure without prior publication as permitted by Regulation 32(2)(a) of the 2016 Regulations (the “New Procurement Process”).
