Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
The contract has been novated to the next and only other tenderer. After the contract was awarded and signed by the successful contractor, without any warning the contractor advised
that it was not in a position to provide the services when required in June 2023. These maintenance services are of critical importance for the Contracting Authority and the PPM
dates had been agreed for each of the 26 substations and 3 remote switching stations earlier in 2023 with each of the 56 buildings that have a shut down during the PPM. There was no
time to go back and rearrange this process again. Shut down must happen during the summer months when the students are not on campus. The contractor agreed to novate the contract to
the next tenderer. All other contract terms remain the same and the overall nature of the contract is not changed.
