Section IV: Procedure
Following Court proceedings in 2016, an earlier project to conserve and adapt this property was halted and work deferred pending consultations with relevant stakeholders. Agreement to complete the work has now been reached and Government have instructed the project to resume. Arising from this, fees have been negotiated with the original professional Design Team and contracts for professional services in relevant building disciplines are being awarded without competition.
The justification for this approach is:
- As set out in the recitals to Directive 2014/24, this has been judged a situation where there is a necessity to use specific knowledge, tools or means which only one operator has at its disposal; this arises from the earlier engagement of the same Operator jointly by the State and a third party to carry out the project and where the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
- By virtue of their embedded specialist knowledge, technical expertise in the relevant area and accrued knowledge of the project, the commissioning agency judge that no other operator could perform the commission to the same level of quality without unacceptable outcomes in terms of timeframe and cost
- The operator possesses the unique combination of technical expertise, in-depth knowledge of the property and the specific agency and legislative framework within which the project must be delivered;
- Relevant legal consideration of Art. 4 & 5 (10) of the Directive lead to a conclusion that award of contract is justified in the circumstances and is permissible within the terms set out in the Directive having regard to relevant regulations regarding aggregation and the financial thresholds currently in force..
